Abstract

This study aims to analyze how the Rad mechanism (return of remaining inheritance

assets) in law can be synthesized as a release of Integral Justice through the Maqasid

interpretation approach. This research begins with the dichotomy between Mathematical

Justice (adherence to the distribution formula in Surah An-Nisa' [4]:11) and Moral Justice

(the principle of protecting rights and maintaining kinship). The Rad problem arises when the

total share of the heirs ( ) does not exhaust the entire inheritance ( ). Methodologically, this

study uses Normative Legal Research (juridical-normative) with a literature review of the

texts of the Qur'an, Hadith, and the books of Islam (and).
