Legal Analysis of Bai' Maushuf Fi Dzimmah Contract in Sale and Purchase Transactions in Langsa City: Implications of Unilateral Cancellation

Abstract

Bai' Maushuf fi Dzimmah Contract in sales transactions ideally creates a clear agreement between the seller and the buyer, prioritizing the principles of justice and consumer protection. However, in practice, transactions that have been agreed upon often face unilateral cancellations, which can harm both the buyer and the seller, especially if there is a discrepancy in the goods or if the agreement is unilaterally altered. This study aims to analyze the application of the Bai' Maushuf fi Dzimmah contract in sales transactions in Langsa City, as well as the legal implications of unilateral cancellations from an Islamic law perspective. Using a normative-empirical approach, this research combines legal theory with practical field observations. The method used is descriptive qualitative, relying on primary data obtained through observation, interviews, and documentation, as well as secondary data in the form of relevant literature related to the research topic. The research findings show that the Bai' Maushuf fi Dzimmah contract is valid in Islamic law if it meets the specified conditions, including an agreement on the specifications of the goods to be delivered in the future. Unilateral cancellations are only allowed if there is a valid reason and mutual agreement from both parties. Unilateral cancellations without clear grounds contradict the principles of justice in Islam and may lead to harm for both the buyer and the seller.
