Political Rights of Persons with Disabilities: A Review of Fiqh Syiasah on the Independent Election Commission

Abstract

Ideally, in the context of Fiqh Syiasah, the political rights of every citizen, including those with disabilities, should be fulfilled fairly and inclusively in accordance with the principles of justice and equality in Islam. In reality, during the 2019 Presidential Election, the Independent Election Commission (KIP) of Langsa City faced various challenges in fulfilling the political rights of persons with disabilities, despite adherence to Law Number 8 of 2016 concerning Persons with Disabilities. This study evaluates the implementation of these policies and the factors affecting the political participation of persons with disabilities. The research method used is descriptive analysis with a qualitative approach, including field data collection through interviews and observations. The results of the study indicate that there are still obstacles such as inaccurate data, suboptimal program implementation, and a lack of public awareness about the political rights of persons with disabilities. Supporting factors such as nearby polling locations, support from local communities, and political education and awareness programs positively contribute to the participation of persons with disabilities in the Presidential Election. Despite these challenges, there was high enthusiasm among persons with disabilities to exercise their voting rights in the 2019 Presidential Election, although not all individuals with disabilities participated.
