Qardh with Additional Fees as Service in Geudubang Jawa: Analysis of Riba Elements in Transactions

Abstract

In the Islamic economic system, the qardh contract is practiced as a form of social solidarity without compensation, purely intended to assist those in need. In Gampong Geudubang Jawa, however, this contract has evolved into a transactional pattern that imposes additional fees as service charges, either explicitly or implicitly, even in cases of delayed repayment. This study aims to conduct an in-depth analysis of the qardh practice accompanied by service fees in Gampong Geudubang Jawa and to examine it within the framework of Fatwa DSN No. 19/DSN/MUI/IV/2001 as a normative standard of Islamic economic law. This article is a qualitative study using field research methods, supported by a normative approach through content analysis of the fatwa and interviews with transaction participants. The findings reveal that such practices deviate from the principles of qardh in Sharia, as they establish profit in advance. The additional fees imposed also contain elements of riba and contradict the fatwa's provisions.
