Enforcement of Islamic Law in the Sharia State: Challenges and Obstacles of the Sharia Department

Abstract

Enforcement of Sharia Law in Aceh is expected to create a society that adheres to the qanun, internalizes Islamic values in daily life, and regards Sharia law as a comprehensive moral and social guideline. Field conditions indicate a gap between written regulations and societal behavior, where low compliance, the influence of cultural habits, limited human resources, inadequate infrastructure, as well as coordination and bureaucratic obstacles affect the effectiveness of law enforcement. This study aims to examine the role, strategies, and operational challenges of the Sharia Office in enforcing qanun, as well as to understand the factors influencing the effectiveness of Sharia law implementation in Aceh. This paper employs a qualitative approach with empirical legal methods, utilizing primary data through interviews and direct observation, along with secondary data from relevant documentation. Data are analyzed using inductive reasoning to produce a comprehensive understanding of institutional dynamics and operational challenges. The enforcement of Sharia through the Sharia Office includes community guidance, supervision, and the sanctioning of violations; however, its effectiveness is still influenced by low public compliance and institutional capacity limitations. This study provides a realistic depiction of the complexities involved in enforcing Sharia law in Aceh.
