Normalizing the Unusual: A Review of Fiqh Muamalah on the Sale of Entrails in Seruway

Abstract

Ideally, under Islamic law, the buyer has full rights over the goods they purchase. In reality, however, in the poultry market in Seruway, parts of a chicken (such as the entrails) that have already been sold to one person are being sold to another buyer. This phenomenon piqued the author's interest because it has become a common practice among poultry traders, seemingly accepted and understood by both parties (seller and buyer). This article falls under field research with a qualitative approach. The methodology used is normative legal study. The research concludes that, in the context of fiqh muamalah (Islamic commercial jurisprudence), one out of three sellers in Seruway engage in selling chicken entrails in a manner that is not in accordance with Islamic law, as the original owner of the chicken (the initial buyer) is neither aware of nor has given permission for the entrails to be sold to another party.
